1. Who these terms cover

These Terms of Service govern companionschat.com and the companions AI applications and services that link to these terms (the “Services”). The operator is companions AI (“we,” “us,” or “our”). These terms apply only to the Services described above. By accepting these terms or using the Services, you agree to them. If you do not agree, do not use the Services.

Our Privacy Policy explains personal information processing. Our EULAUsage Policy addresses software licensing. A purchase screen or promotion may state additional terms for that specific offer; mandatory consumer rights always take priority.

2. Adults only and your account

You must be at least 18 and legally able to enter this agreement. Do not misrepresent your age or help someone under 18 access the Services. We may restrict access when age eligibility cannot be established.

Provide accurate account information, protect your sign-in credentials, and tell us if you suspect unauthorized access. Do not sell, rent, or share accounts to evade limits. You are responsible for activity you authorize; this does not remove any rights you have concerning unauthorized transactions or our security obligations.

3. AI characters, stories and memory

Characters, conversations, roleplay, Story Worlds and Playable Series are fictional entertainment. You interact with AI, not a human companion or a licensed professional. Outputs can be inaccurate, repetitive, offensive or inconsistent. Memories, recaps and narrative continuity may contain mistakes or omit information. Check important information yourself.

The Services are not medical, mental-health, legal or financial advice, therapy, an emergency service, or a replacement for real-world relationships. Do not rely on a character to respond to emergencies or make consequential decisions. Contact local emergency services if you face immediate danger.

Availability, models, response limits, memory capacity and story features depend on the version and offer you use. Examples on the website illustrate the experience and do not guarantee particular responses or outcomes. A subscription does not remove safety restrictions or guarantee unlimited capacity unless the purchase offer expressly says so.

4. Acceptable use and safety

Our Usage Policy supplements these terms with content, account and fair-use rules, reporting instructions and review options.

You may explore lawful fictional stories within the limits of the available features. Adult access does not mean that every kind of content is permitted. You must not use the Services to:

• Sexualize, exploit or groom anyone under 18, including fictional or AI-generated depictions; misstate a character’s age to evade safeguards.
• Create or distribute non-consensual intimate images, sexual exploitation, or deceptive impersonations of real people, including misuse of their voice or likeness.
• Threaten or facilitate real-world violence, terrorism, stalking, trafficking, fraud or other unlawful harm; encourage or provide instructions for self-harm.
• Harass people, expose private information, violate intellectual property or privacy rights, or upload content you lack permission to use.
• Distribute malware, obtain unauthorized access, circumvent payment or safety controls, or use automation to overload the Services.

We may filter or refuse requests, restrict content or suspend access to address violations, safety risks or legal obligations. You may report concerns or request reconsideration at info@companionschat.com. Include the content location, what happened and enough information to investigate; do not send illegal images. Automated decisions can be mistaken, and reporting does not guarantee a particular outcome.

5. Your content and creative rights

You retain the rights you have in your submitted messages, character descriptions, personas and other materials. You give us a non-exclusive permission to host, process, reproduce and display that content as necessary to provide the features you request, maintain continuity, investigate abuse and meet legal obligations. Service providers may perform these activities for us. This permission does not transfer ownership of your private conversations or authorize their use in public advertising.

If you choose a public sharing or publishing feature, you authorize display and distribution to the audience you select. Others may retain material you share, even after you remove your copy. Private content is not made public merely because you use an AI feature. Personal information is handled under the Privacy Policy.

AI output may not be unique or eligible for copyright. To the extent we hold transferable rights in output generated for you, we permit your lawful use of that output, subject to third-party rights and these terms. This does not transfer our brand, software, catalog artwork or pre-existing stories. Imports and exports do not grant rights to another creator’s characters, conversations, likeness or source material. Do not import third-party private information without permission.

6. Subscriptions, purchases and Pieces

The price, billing period, included features, allowances, taxes and any trial terms shown before purchase govern your purchase. Recurring subscriptions renew until cancelled under the purchase platform’s rules. Cancel through the account or store where you subscribed before its displayed renewal deadline. Deleting the app or an account is not the same as cancelling a store subscription. Cancellation ordinarily stops future renewals and leaves access until the paid period ends, subject to the offer and applicable law.

Pieces, where offered, are digital credits for eligible in-service features. They are not currency, an investment, a deposit or a claim to cash. They cannot be sold or transferred outside authorized features. The displayed cost applies before you spend them. Any restrictions on earned or promotional credits must be disclosed with the offer. Subscription allowances and purchased Pieces are distinct; a plan’s reply limit does not itself authorize an additional charge.

For billing errors, missing purchases or failed transactions, contact us with your receipt information, excluding full payment-card details. App Store purchases and refund requests are also subject to Apple’s process. Refunds, withdrawal rights and other remedies required by law remain available; these terms do not impose an absolute “no refunds” rule. We will disclose material pricing or renewal changes and obtain consent where required.

7. Copyright, intimate imagery and other reports

Send rights complaints to info@companionschat.com. Identify the work or right, the specific content and location, your contact details, and the basis for your authority. For copyright notices, include a signature, a good-faith belief that the use is unauthorized, and a statement that the information is accurate and you are the rights holder or authorized to act for them, under penalty of perjury. We may request clarification and restrict repeat infringers as appropriate.

For non-consensual intimate imagery, use the subject “Urgent intimate-image removal”; provide the location, your signature, a good-faith statement that the depiction was shared without consent, and your authority if acting for the depicted person. We will address valid notices within applicable legal deadlines, including the 48-hour removal requirement where the TAKE IT DOWN Act applies, and take the measures required for known identical copies. Do not attach the intimate image itself when a location is sufficient.

8. Availability and ending access

We may maintain, update or discontinue features and restrict access for material breaches, fraud, security risks or legal requirements. Where practicable and lawful, we will explain significant account restrictions and allow you to contact us for review. Immediate action may be necessary for safety or security. Discontinuing paid access does not remove any legally required refund or other remedy.

You may stop using the Services and request account deletion. Content export depends on the features available, so keep copies of material you need. The Privacy Policy explains deletion and retention. Terms that reasonably need to survive termination, including accrued payment obligations, intellectual property and dispute provisions, continue to apply.

9. Disclaimers and responsibility

To the extent permitted by law, the Services are provided “as is” and “as available.” We do not promise uninterrupted access, error-free AI, particular emotional or creative outcomes, or that output is suitable for a specific purpose. Nothing excludes warranties, reasonable-care duties or remedies that the law does not allow us to exclude.

To the extent legally permitted, we are not liable for indirect or consequential losses arising from your use of the Services. Our aggregate liability for claims relating to the Services is limited to the greater of US$100 or the amount you paid us for the affected Services during the preceding 12 months. These limits do not apply to fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, or any liability or consumer remedy that cannot lawfully be limited.

10. Disputes, changes and contact

Florida law governs these terms to the extent it does not displace mandatory protections in your place of residence. Disputes may be brought before courts with competent jurisdiction; nothing here removes a consumer’s right to use their local courts where the law provides that right. These terms do not introduce mandatory arbitration or a class-action waiver.

Please contact us first so we can try to resolve concerns, without delaying a legal deadline or urgent remedy. If a provision is unenforceable, the remaining terms continue to apply. We will post changes with a revised date and provide additional notice or seek agreement where required. Changes are prospective and do not remove rights already accrued.
